Data Protection Declaration

Seekers Event GmbH and their management take data protection very seriously. In the following we would therefore like to inform you about using our internet pages and the type, purpose, and scope of any processing of personal data related to this. We would also like to inform all data subjects about the rights that they are entitled to.

The controller of the processing of personal data shall be the natural or legal person who decides individually or with other people on the purpose and means of the processing of personal data.

2. Data Compilation during Visits to our Website

In the case that you use our website purely for informational purposes, i.e. if you do not register or submit information to us in any other way, we will only collect the data that your browser transmits to our server (server logfiles). If you view our website, we will collect the following data that is technically necessary for us in order to display the website to you:

- Our website visited
- Date and time of the access
- Quantity of the sent data in bytes
- Source/referrer from which you reached the page
- Browser used
- Operating system used
- IP address used (in anonymised form, if applicable)

In accordance with Article 6, section 1, lit. f of the GDPR, the processing is performed on the basis of our legitimate interest in the improvement of the stability and functionality of our website. The data will not be transmitted to third parties or used in any other way. However, we reserve the right to examine the server logfiles subsequently if specific indications should point to an unlawful use.

3. Cookies

In order to make the visit to our website attractive and enable the use of certain functions, we use cookies on various pages. These are small text files that are placed on your end device. Some of the cookies that we use will be deleted subsequent to the end of the browser session, i.e. after you have closed your browser (session cookies). Other cookies will remain on your end device and enable us or our partner companies (third party cookies) to recognise your browser when you visit our website again (persistent cookies). If cookies are placed, these collect and process on an individual basis certain user information such as browser and location data as well as IP address values. Persistent cookies will be deleted automatically subsequent to a specified time period, which may vary depending on the cookie. If individual cookies implemented by us also process personal data, the processing will be performed in accordance with Article 6, section 1, lit. f of the GDPR for safeguarding our legitimate interests in the optimal functionality of the website as well as in a customer-friendly and effective organisation of the visit to the page. In some circumstances, we cooperate with advertising partners that support us in making our internet services even more interesting for you. For this purpose and for this case, cookies of partner companies (third party cookies) will also be stored on your hard drive when you visit our website. If we cooperate with such aforementioned advertising partners, you will be informed individually and separately within the sections below about the use of such cookies and the scope of the information collected in each case.

4. Contacting us

If you contact us (e.g. by contact form or by email), personal data will be collected. It is indicated in the respective contact form which data will be collected when such a form is used. This data is stored and used exclusively for the purpose of responding to your enquiry or for establishing contact as well as for the technical administration related thereto. The legal basis for the processing of your data is our legitimate interest in responding to your enquiry in accordance with Article 6, section 1, lit. f of the GDPR. If you contact us in order to conclude a contract, Article 6, section 1, lit. b of the GDPR is an additional legal basis for the processing. Your data will be erased after your enquiry has been completely processed; this is the case if the circumstances indicate that the matter has been conclusively clarified and provided that there are no statutory obligations to retain the data.

5. Usage of your Data for Direct Advertising 

Subscription to our email newsletter

If you subscribe to our email newsletter, we will send you information regarding our services on a regular basis. Your email address is the only mandatory information for the receipt of the newsletter. You may submit any further data on a voluntary basis, which will be used for the purpose of addressing you personally. We use the double opt-in procedure for distributing the newsletter. This means that we will only send you an email newsletter if you have expressly confirmed to us that you consent to the receipt of newsletters. We will then send you a confirmation email in which you will be required to confirm by clicking a corresponding link that you would like to receive newsletters in the future. 

By means of activating the confirmation link, you grant us your consent to use your personal data in accordance with Article 6, section 1, lit. a of the GDPR. Upon your subscription to the newsletter, we will store your IP address that has been registered by the internet service provider (ISP) as well as the date and time of the subscription in order to be able to detect any possible misuse of your email address at a later point in time. We will use the data, which we collect upon the subscription to the newsletter, exclusively for purposes of advertising by means of the newsletter.

You may unsubscribe from the newsletter at any time using the link in the newsletter provided for that purpose or by means of a corresponding message to the controller indicated above. Once you have unsubscribed, your email address will be removed from our newsletter mailing list without delay, unless you have expressly granted your consent to a further use of your data or unless we reserve the right to further use your data which is legally permitted and of which we inform you in this Declaration.

6. Use of Social Media: Videos

Use of YouTube videos

This website uses the YouTube embedding function for displaying and playing videos of the provider “YouTube” that is a company of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).

When doing so, the extended data protection mode is used, during which – in accordance with the provider’s information – the storage of user information will only commence when the video(s) is/are played. If the playing of embedded YouTube videos is started, the provider uses YouTube cookies in order to collect information on user behaviour.

As indicated by YouTube, this information is used among other things for compiling video statistics, improving user friendliness, and preventing abusive behaviour. If you are logged into your Google account, your data will be directly associated to your account when you click on a video. If you do not wish your data to be associated to your YouTube profile, you must log out from your account before activating the the video’s play button. Google stores your data (even for users who are not logged in) as usage profiles and analyses them. Such an analysis is performed in particular in accordance with Article 6, section 1, lit. f of the GDPR on the basis of the justified interests of Google in the display of personalised advertisements, market research, and/or the demand-based design of their website. You are entitled to a right of objection against the creation of these user profiles, whereby you must contact YouTube in order to exercise this right.

Irrespective of whether the embedded videos are played or not, contact to the Google network “DoubleClick” will be established whenever this website is visited, which may trigger further data processing operations that are beyond our range of influence.

7. Web Analysis Services

Google (Universal) Analytics - Google Analytics

This website uses Google Analytics, a web analysis service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses cookies (text files) that are stored on your computer and enable your use of the website to be analysed. The information regarding your use of this website generated by the cookie (including the shortened IP address) is normally transferred to a server of Google in the USA and stored there. 

This website uses Google Analytics exclusively with the extension “_anonymizeIp()”, which ensures the anonymisation of the IP address by shortening it and excludes any direct tracing to a specific person. By means of the extension and prior to the use of your IP address, Google shortens it within the membership states of the European Union and in other membership states of the Agreement on the European Economic Area. Only in exceptional cases, the complete IP address will be transferred to a server of Google in the USA and shortened there. In these exceptional cases, the processing will be performed in accordance with Article 6, section 1, lit. f of the GDPR on the basis of our legitimate interest in the statistical analysis of the user behaviour for optimising and marketing purposes.

On our behalf, Google will use this information for the purpose of analysing your use of the website, for creating reports about the website activities, and for providing other services to us related to the use of the website and the internet. The IP address transmitted by your browser within the scope of Google Analytics will not be combined with other Google data.

You can prevent the storage of the cookies by appropriately adjusting the settings in your browser software; however, we would like to point out that in this case you may not be able to use all the functions of this website to their full extent. 8. Retargeting/Remarketing/Referral Advertising

Facebook Custom Audience using the pixel method

This website uses the Facebook pixel of Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA (“Facebook”). In the case that explicit consent is granted, the behaviour of users can be tracked in this way after they have viewed or clicked on a Facebook advertisement. This procedure is used to analyse the effectiveness of Facebook advertisements for statistical and market research purposes and may contribute to optimising future campaigns.

The collected data is anonymous for us, i.e. we are unable to draw any conclusions regarding the identity of the users on this basis. However, the data is stored and processed by Facebook so that it can be linked to the respective user profile and Facebook can use the data for their own advertising purposes in accordance with the Facebook data policy (www.facebook.com/about/privacy). You can enable and prevent Facebook as well as their partners to place advertisements on and outside of Facebook: www.facebook.com/ads/preferences/?entry_product=ad_settings_screen

Furthermore, a cookie may be stored on your computer for these purposes. These processing operations will be performed exclusively if the express consent in accordance with Article 6, section 1, lit. a of the GDPR has been granted. 

Exclusively users who are older than 13 years may grant their consent to the use of the Facebook pixel. If you are younger, please ask your parent or legal guardian for permission.

In order to disable the use of cookies on your computer, you can adjust the settings of your internet browser so that in the future, cookies can no longer be placed on your computer or cookies that have already been placed will be deleted. However, if you disable all cookies, this may lead to the fact that some functions can no longer be carried out on our internet pages. 9. Mobile App

In addition to the services on our website, we provide a mobile app that can be installed on end devices. 

Upon downloading the app from the respective store, your personal data that is important for the installation will be transferred to the store operator. This is, for example, your user name, your email address or your payment data. We are unable to influence this process.

Personal data that is required for the use of the app is collected and processed on the basis of Article 6, section 1, lit. f of the GDPR. This data is necessary in order to ensure the technical functionality and security of the app and in order to design the services according to your needs. We collect and process the following data:

- Anonymised IP address
- Date and time of the enquiry
- Access frequency
- Location data, if you allow it
- Accessed subpages
- Type of the operating system
- Mobile service provider
- App version

For the collection of some of this data, we use Google Analytics in our app. In this case, the data is sent to the Google servers in the USA. For detailed explanations regarding the functionality of Google Analytics and how you can prevent this data collection, we refer you to item 7 of this Data Protection Declaration.

Under no circumstances, will we pass your data on to third parties.

10. Tools and Miscellaneous

10.1 Google reCAPTCHA

On this website, we also use the reCAPTCHA feature of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). This feature is mainly used to differentiate whether an entry is made by a natural person or, in an abusive manner, by a mechanical and automated processing. The service includes the transfer of the IP address to Google and, if applicable, other data that Google requires for the reCAPTCHA service; it is performed in accordance with Article 6, section 1, lit. f of the GDPR on the basis of our legitimate interest in determining the fact that activities on the internet are motivated by the individual will of a person, and in the avoidance of abuse and spam.

10.2 Google Web Fonts

For the purpose of a uniform display of fonts, this website uses Web Fonts that are provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). When you access a page, your browser loads the required Web Fonts into your browser cache in order to display text and fonts correctly. For that purpose, the browser you use needs to establish a connection to the Google servers. In this way, Google learns that our website has been accessed through your IP address. Google Web Fonts are used in order to display our online services in a uniform and appealing way. This constitutes a legitimate interest within the meaning of Article 6, section 1, lit. f of the GDPR. If your browser does not support Web Fonts, a standard font of your computer will be used.

11. Rights of the Data Subject

11.1 The applicable data protection law grants you comprehensive rights for data subjects (rights of access and intervention) in relation to the controller as regards the processing of your personal data, about which we will inform you below:

- Right of access in accordance with Article 15 of the GDPR: In particular, you have a right to obtain information about your personal data processed by us, the purposes of the processing, the categories of the processed personal data, the recipients or categories of recipients to whom your data has been or will be disclosed, the scheduled storage period or the criteria for the determination of the storage period, about the existence of a right to rectification, to erasure, to the restriction of the processing, to object against the processing, to lodge a complaint with a supervisory authority, about the origin of your data if we have not collected this from you, the existence of an automated decision-making including profiling and, if applicable, substantiated information regarding the logic involved and the consequences and intended effects of such a processing, as well as about your right to information about which safeguards exist in accordance with Article 46 of the GDPR if personal data is transferred to third countries;

- Right to rectification in accordance with Article 16 of the GDPR: You are entitled to a right to rectification without undue delay of inaccurate data and/or the completion of incomplete data relating to you that is stored with us;

- Right to erasure in accordance with Article 17 of the GDPR: You are entitled to the right to request the erasure of your personal data if the preconditions of Article 17, section 1 of the GDPR are met. However, this right shall in particular not exist if the processing is required for exercising the right to the freedom of expression and information, for fulfilling a legal obligation, for purposes of the public interest or for asserting, exercising or defending legal claims;

- Right to the restriction of the processing in accordance with Article 18 of the GDPR: You are entitled to the right to request the restriction of the processing of your personal data – as long as the accuracy of your data, which is contested by you, is verified – if you oppose the erasure of your data and request the restriction of the use of your data instead, if you require the data for asserting, exercising or defending legal claims, after we no longer need this data if the purpose of the processing is fulfilled or if you have made an objection for reasons relating to your particular situation as long as it is still not determined whether our legitimate reasons prevail;

- Right to information in accordance with Article 19 of the GDPR: If you have asserted the right to rectification, erasure or restriction of the processing vis-à-vis the controller, the controller shall be obliged to inform all recipients, to which the personal data relating to you has been disclosed, of this rectification or erasure of the data or the restriction of the processing, unless this proves to be impossible or involves disproportionate effort. You shall be entitled to the right to be informed about these recipients. 

- Right to data portability in accordance with Article 20 of the GDPR: You have the right to request to receive your personal data, which you have provided to us, in a structured, commonly used, and machine-readable format or to request the transmission of this data to another controller if this is technically feasible;

- Right to withdraw granted consents in accordance with Article 7, section 3 of the GDPR: You have the right to withdraw any granted consent to the processing of data at any time and with effect for the future. In the case of such withdrawal, we will erase the data concerned without delay, unless any further processing may be founded on a legal basis for the processing without consent. The withdrawal of the consent does not affect the lawfulness of the processing performed on the basis of the consent up until the withdrawal;

- Right to lodge a complaint in accordance with Article 77 of the GDPR: If you consider that the processing of the personal data relating to you infringes the GDPR, you have – without prejudice to any other administrative or judicial remedy – the right to lodge a complaint with a supervisory authority, in particular in the member state of your habitual residence, your place of work or the place of the alleged infringement.

11.2 RIGHT TO OBJECT

IF WE PROCESS YOUR PERSONAL DATA WITHIN THE SCOPE OF A WEIGHING OF INTERESTS ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST, YOU HAVE THE RIGHT AT ALL TIMES TO OBJECT TO THIS PROCESSING FOR REASONS THAT ARISE FROM YOUR PARTICULAR SITUATION AND WITH EFFECT FOR THE FUTURE. 

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL TERMINATE THE PROCESSING OF THE DATA CONCERNED. HOWEVER, WE RESERVE THE RIGHT TO FURTHER PROCESS THIS DATA IF WE CAN SUBSTANTIATE MANDATORY REASONS FOR THE PROCESSING, WHICH ARE WORTH PROTECTING AND WHICH OVERRIDE YOUR INTERESTS, CONSTITUTIONAL RIGHTS, AND FUNDAMENTAL FREEDOMS OR IF THE PROCESSING SERVES FOR THE ASSERTION, EXERCISE OR DEFENCE OF LEGAL CLAIMS.

IF WE PROCESS YOUR PERSONAL DATA IN ORDER TO PERFORM DIRECT ADVERTISING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA RELATING TO YOU FOR THE PURPOSE OF SUCH ADVERTISEMENTS. YOU MAY MAKE THE OBJECTION AS DESCRIBED ABOVE. 

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL TERMINATE THE PROCESSING OF THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.

12. Period for which the personal data will be stored

The period for which the personal data will be stored is calculated according to the respective statutory retention period (e.g. retention periods under commercial and fiscal law). Subsequent to the expiry of the respective period, the corresponding data will be erased routinely, unless it is still required for fulfilling or initiating contracts and/or we do not maintain a legitimate interest in the continued storage.
